TOWN OF ESSEX, NEW YORK TOWN BOARD MEETING
June 21, 2011

Sewer Law Ordinance
Roll Call:
Councilman MacDougal, Councilwoman LaPine, Councilman LaForest, Councilman Wrisley, Supervisor Boisen
Visitors:
John I. Mesick and John Ferry and Catherine DeWolff, who was filling in as Secretary, for the Town Clerk, Audrey Hoskins.
Supervisor Boisen opened the Public Hearing on the Sewer Law Ordinance at 6:09 p.m. The Board members have a copy of the Draft Revision of the Town of Essex Sewer District#1 Wastewater Treatment/User Charge Ordinance and copies of same were made available to the public. The Supervisor advised the Board that some of the things the Engineer came up with need to be addressed, first being under page 1, Article 2, section 2.2 Operations and Maintenance, the responsibility of the homeowner and the Town. It was agreed that the wording should be amended to read The responsibility of the Homeowner begins at the edge of the property line, sidewalk or pavement, whichever occurs first.
Page 4, Article 5.0, Lateral Connections and Pumps, Section 5.1 and 5.2 shall be amended to include first pump will be included by the Town, any or all others will be the responsibility of the Homeowner. Under Article 6.0, Hook Up Charge Where No YConnection Exists, should include the phrase, The Contractor will be hired by the Town of Essex at the Homeowner’s expense.
Page 11, Article 13.0, Rates and Charges Based Upon User Units, Section 13.2 shall be amended to read up to 2.5 peopleis defined as a user. Section 13.3, the word watershall be replaced with the word sewerand last sentence shall read 3,000 or more gallons usage per quarter will be rated at ½ cents (0.05) per gallon. Section 13.5 shall be amended to User unit will pay $233 Debt Service plus usage, reviewed annually. With regard to operational costs, here it was agreed that this section will be revisited when the Board gets the accurate figures.
Page 12, under Article 15.0, Billing/Late Payment/Penalties, capital costsshall be replaced with debt service. Section 15.2 shall be amended to read Three percent (3%) interest of the total unpaid bill will be charged for each quarter the bill remains delinquent.
Councilman LaForest advised the Board that he will make these changes and send it back. Supervisor Boisen advised that once that is done, we will run it by the attorney and adopt it hopefully at the July meeting, if not then, in August.
Public Comment:
John Mesick advised the Board that he lost a marker on his property as well as a 3diameter trunk Maple tree, due to the construction process with the Sewer Project. Supervisor Boisen advised Mr. Mesick that Jim Dugan will get in touch with him and the Town will make it right.
Close of Public Hearing:
There being no further comment, a motion was made by Councilwoman LaPine to close the Public Hearing, seconded by Councilman MacDougal. Roll call: Councilman MacDougal-yes, Councilwoman LaPine-yes, Councilman LaForest-yes, Councilman Wrisley-yes, Supervisor Boisen-yes. None opposed. Motion to close the Public Hearing passes and the Public Hearing is closed at 6:48 p.m.
A motion to enter Executive Session was raised by Supervisor Boisen and seconded by Councilwoman LaPine. Roll call: Councilman MacDougal-yes, Councilwoman LaPine-yes, Councilman LaForest-yes, Councilman Wrisley-yes, Supervisor Boisen-yes. With all yes, and none opposed, Executive Session was entered at 6:56 p.m.
A motion to end Executive Session was made by Councilman MacDougal and seconded by Councilman LaForest. Roll call: Councilman MacDougal-yes, Councilwoman LaPine-yes, Councilman LaForest-yes, Councilman Wrisley-yes, Supervisor Boisen-yes. With all yes, and none opposed, Executive Session was ended at 7:56 p.m., with no action taken.
There being no further business before the Town Board, Councilman MacDougal motioned to adjourn and seconded by Councilwoman LaPine. Roll call: Roll call: Councilman MacDougal-yes, Councilwoman LaPine-yes, Councilman LaForest-yes, Councilman Wrisley-yes, Supervisor Boisen-yes. With all yes, and none opposed, the meeting is adjourned at 7:58 p.m.
