Minutes of Special Meeting
June 6, 2011, 5:30 p.m.
Call to Order
Chairman Van Hoven called the meeting to order at 5:30 p.m.
Planning Board Members present: Michelle Cassidy, Derrick Wrisley, James Van Hoven, David Hislop, H. Nicholas Muller, III, Donald Hollingsworth and Mark Walker.
Guests: Kevin Hall, representative for Karin N. Keene, Brian Trzaskos and Lauren Murphy.
Amendment to Special Use Permit #2011-3
Tax Map 40.73-3-2
Herbert and Karen Dalton old Tart Store to Lessee œLive Well, Brian Trzaskos, Applicant. Amend permit to revise originally permitted sign to a 30 diameter round, double sided wooden sign, to be hung in a similar fashion to the one at the Essex Inn.
Mr. Trzaskos was available to answer questions from the Board. Chairman Van Hoven read the Amendment to the Board and it was deemed acceptable and in compliance with all statutes. A motion was made by David Hislop to adopt the Amendment, seconded by Michelle Cassidy. Unanimous vote yes. Amendment passes and is accepted as part of the original permit and a copy of same is made a part of these minutes.
Karin N. Keene Minor Subdivision
Tax Map 48.4-1-9 and 49.3-1-1
Minor two lot Subdivision of property located at 1723 NYS Rt. 22, Whallonsburg, NY, Town of Essex, NY. Review to deem the application complete and schedule Public Hearing for June 16, 2011.
Kevin Hall, Surveyor, is present as Karin Keene’s representative. He reviewed
the revised map of said subdivision with the Board. The Chairman advised that this is now coming to us from the ZBA, who has issued a variance on the subdivision and our determination will include all conditions noted as part of their recommendation. Our job today is not to issue the permit, but to declare the application complete, to ask questions and schedule the Public Hearing to take place a week from Thursday on June 16. Mr. Hall went into detail regarding the map and the parcels involved. The Chairman queried Mr. Hall regarding building rights and how they are determined. Mr. Hall advised that building rights cannot be transferred from one land use to another. Mr. Wrisley asked about acreage with regard to the building right. Ms. Cassidy asked about the inconsistencies of the mapped areas, Town vs. APA. Mr. Walker queried whether theoretically putting a sand bed in the upper portion of the property located in the Hamlet that goes through a freeze/thaw period, if that could be considered an opportunity for yet another sub-division. Theoretically, Mr. Hall, concurred that is would be a possibility in the future of the property with caveat to the wetlands issue. Ms. Cassidy asked Mr. Hall if the other land is being sold to somebody else and what do they plan to do with it. Mr. Hall replied, yes, the forty acres including the existing house are being sold and his understanding is that it would be some sort of organic farming enterprise, but that his knowledge is not first hand. He advised that the Planning Board would be creating a legal lot whether those people buy it or not, and what they can do with it is what is allowed by law. He also advised that the lot does not lend itself to development as most of it is wetlands.
Mr. Hollingsworth made a motion to declare the application complete, Mr. Walker seconds. All in favor, yes, opposed, no, motion passes and the application is deemed complete. Motion was made by Mr. Hislop to schedule a Public Hearing on June 16. Mr. Wrisley seconds. All in favor, yes, opposed, no. A Public Hearing will be scheduled for June 16, 2011, at the next regular meeting of the Planning Board.

Mr. Hollingsworth motioned to declare the meeting adjourned, Mr. Walker seconded. Vote is unanimous to adjourn. Meeting is adjourned at 5:55 p.m.
