Minutes of Public Hearing and Regular Meetings of May 2, 2013
PUBLIC HEARING
Call to Order: Chair Van Hoven called the public hearing to order at 7 PM.
Present: Mary Anne Schultz, Lauren Murphy, Ken Hughes, Tim Sherman, Larry Smead, Rick Dalton, Karen Judge, Stoney Bailey, Gerald Spooner, William Bateman, (marina operator and spouse?)
Attendance: Present: Olive Alexander, H. Nicholas Muller III, Pat Tivnan, James Van Hoven, Mark Walker, and Derrick Wrisley. Absent: David Hislop.
Special Use Permit: Tax map #40.73-3-4000. Application to move the RENEW Thrift Shop and Weaving Studio to The Manse at 2306 Main St., Essex. The use for this building is currently residential; the request is a change of use to Retail. The building is in the Essex Hamlet and Historic Overlay District.
There were no public comments on the application. H. Nicholas Muller III moved the hearing be closed; Derrick Wrisley seconded. Motion passed unanimously.
REGULAR MEETING
Call to Order: Chair Van Hoven called the regular meeting to order at about 7:05 PM.
Present: Mary Anne Schultz, Lauren Murphy, Ken Hughes, Tim Sherman, Larry Smead, Rick Dalton, Karen Judge, Stoney Bailey, Gerald Spooner, — Bateman, (marina operator and spouse?)
Attendance: Present: Olive Alexander, H. Nicholas Muller III, Pat Tivnan, James Van Hoven, Mark Walker, and Derrick Wrisley. Absent: David Hislop.
Approval of Minutes of April 4, 2013 Meeting of the Planning Board:
Mr. Muller noted that the minutes do not accurately reflect the fact that James Van Hoven and David Hislop were absent. Mark Walker moved that the minutes be approved with that correction Seconded by Pat Tivnan. Motion carried unanimously.
Old Business:
Special Use Permit: Tax map #40.73-3-4000. Application to move the RENEW Thrift Shop and Weaving Studio to The Manse at 2306 Main St., Essex. The use for this building is currently residential; the request is a change of use to Retail. The building is in the Essex Hamlet and Historic Overlay District.
A short form SEQRA for the project was reviewed. H. Nicholas Muller III moved and Olive Alexander seconded that a negative declaration be recorded. Motion passed unanimously.
A DRAFT permit for the project was reviewed. Mark Walker moved to approve it, seconded by Pat Tivnan. Motion passed unanimously.
New Business:
Special Use Permit: Tax map #40.73-2-9.000 .Ken Hughes, applicant. Application to create a computer consulting business in the front part of the building, with a residence at the rear. This front part of the building has been used in the past for commercial purposes; approving this application would continue that use. The building is in the Essex Hamlet and Historic Overlay District.
Mr. Muller noted that since Thomas Stransky is the owner of the property, his signature should be on the application, with Ken Hughes as his representative. All agreed.
- Nicholas Muller III moved that the application be deemed complete pending the above correction. Seconded by Derrick Wrisley. Motion passed unanimously.

Site Plan Review: Tax map #40.73-6-7.000. John Orberg, applicant, represented by Tim Sherman. (Former Shirley Estes home.) Applicant wishes to construct an enlarged deck and stairs and do miscellaneous minor exterior renovations. The building is in the Essex Hamlet and Historic Overlay District.
- Nicholas Muller III moved that the application be deemed complete. Seconded by Pat Tivnan. Motion passed unanimously.
- Nicholas Muller III moved that a public hearing on the application be held on June 6, 2012. Derrick Wrisley seconded. Motion passed unanimously.
Permit Renewal: Tax map #40.73-6-8.000. The Rudder Club. Larry Smead, applicant. Mr. Smead, the new owner, wishes to reopen the restaurant, which has not been in use for several years. There will be no change in use and no exterior changes to the building. The building is in the Essex Hamlet and Historic Overlay District.
—–, the manager of the Marina and Rudder club noted a correction that the restaurant has been in continuous use since the original permit was issued, and offered proof of that fact. This means that in accordance with the Zoning Law a new permit is not required, so no action was required or taken by the Planning Board.
Boundary Line Adjustment: Tax maps #40.73-2-11.000 & #40.73-2-12.000. Rick Dalton and Karen Judge, owners. The renovations to the CFES (former Van Ornam) building require adjustments to the property line between it and the Essex Inn to ensure a perpetual easement that will permit safe egress from the former building in the event of an emergency. This will also place the renovated CFES addition completely within the footprint of its property line. Both properties are in the Essex Hamlet and Historic Overlay District.
- Nicholas Muller III moved that the boundary line adjustment be approved. Seconded by Olive Alexander. Motion passed unanimously.
Special Use Permit Amendment: Tax map #40.73-8-1.086. John and Miriam Klipper, owners, Stoney Bailey representative. A permit to renovate the building was issued some time ago and work has been progressing. Recently architect John Mesick recommended adding two small dormers to the rear extension of the building. Both are consistent with the building’s architecture and will be barely visible from the street. The building is in the Essex Hamlet and Historic Overlay District.
- Nicholas Muller III moved that the special use permit amendment be approved. Seconded by Derrick Wrisley. Motion passed unanimously.
Special Use Permit Amendment: Tax map #40.65-3-5.200. John Doyle, owner, Deb Schrodt, renter and applicant. Ms. Schrodt wishes to expand a menu of food offerings at the Pink Pig and allow them to be consumed on the premises. The building is in the Essex Hamlet and Historic Overlay District.
Since neither Mr. Doyle nor Ms. Schrodt was present, this matter was tabled.
Site Plan Review: Tax map #40.3-2-8.111. (Former Essex Country Store.) Essex Legacy Trust, applicant, represented by Larry Smead, Gerald Spooner and William Bateman. Applicant wishes to construct a 26’ by 30’ shed on the side of the existing building. The building is in the Shoreline Overlay District.
Architect Bateman explained the project and distributed scale drawings.
Olive Alexander moved that the application be deemed complete; seconded by Mark Wrisley. Motion passed unanimously.

The applicants asked the Planning Board if approval of the construction of a five foot board fence enclosure at the rear of the property is required by the Board. Following discussion the Board informed the applicants that since the fence is at the rear of the property and barely visible, only a permit from the Zoning Officer will be required.
Report of the Planning Board Chair: Chair Van Hoven reported that the Town Board has scheduled a review and possible vote on the proposed revisions to the Zoning Law at its May 16, 2013 meeting.
Report of the Zoning Officer: Lauren Murphy referred the Board to her written report, recently distributed.
Public Comment: None.
Adjournment: Mark Walker moved the meeting be adjourned. Seconded by Derrick Wrisley. Motion passed unanimously. Meeting adjourned at about 7:40 PM
