Public Hearing
Call to Order
Chairman Van Hoven called the Public Hearing meeting to order at 7:00 p.m. with The Pledge of Allegiance.
Attendance
Present: Olive Alexander, James Van Hoven, David Hislop, Derrick Wrisley, Mark Walker, H. Nicholas Muller, III
Absent: Thomas Stransky
Also present: Travis Sheehan, Lee Adams, Brookes Couc, Jaye Roseborough, Sharon Boisen, Martha Smiles, Emily Phillips, David Sayre, Mark Hall and Lauren Murphy – Code Enforcement Officer.
Public Hearing(s)
Tax Map #40.11-1-24.000 Smiles -Site Plan Review -Demolition of old camp and construction of replacement camp at 11 Pearson Way, Essex, NY 12936 (Crater Club). Martha Smiles appeared as the Applicant and Mark Hall was in attendance as the Representative for the Applicant’s.
The Chairman advised the public in attendance that the Planning Board is familiar with the project and asked if there were any questions from the public. There being none, Mr. Muller motioned to close the Smiles Public Hearing, seconded by Mr. Hislop, the vote to close is unanimous, Aye-6 No-0 Motion carried.
Tax Map #49.-13-2.000 Stransky -Site Plan Review -Accessory structure storage shed with 3 or 4 bays for tractor and other equipment at 1420 Whallons Bay Road, Essex, NY 12936.
The Chairman advised the Public that Lee Adams will be representing the Stransky’s at this meeting and asked if the public had any questions about the project. There being none, Mr. Muller motioned to close the Stransky Public Hearing, seconded by Mrs. Alexander, the vote to close is unanimous, Aye-6 No-0 Motion carried.
Tax Map #49.15-3-12.000 Levine -Site Plan Review -New 30’x 40’ Garage at 20 Spire Way, Off Albee Lane, Essex, NY 12936
The Chairman advised that Travis Sheehan is here to represent the Levine’s at this meeting and asked of the public had any questions about the project. There being none, Mr. Muller motioned to close the Levine Public Hearing, seconded by Mr. Wrisley, the vote to close is unanimous, Aye-6 No-0 Motion carried.

On a motion by Mr. Muller to close the Public Hearing portion of the meeting, seconded by Mr. Hislop, the motion carried by unanimous vote, Aye-6 No-0

Chairman Van Hoven called the Regular Meeting to order at 7:06 p.m.

On a motion to accept the minutes of the June 19, 2014, by Mr. Hislop, seconded by Mrs. Alexander, the motion carried by unanimous vote, Aye-6 No-0
Old Business -Approval of Draft Permits
Draft permit #2014-11: Tax Map #40.11-1-24.000 Smiles -Site Plan Review -Demolition of old camp and construction of replacement camp at 11 Pearson Way, Essex, NY 12936 (Crater Club).
The Chairman noted that we did the SEQRA at our last meeting and asked for a motion to approve the draft permit as written. On a motion by Mr. Muller to approve the permit, seconded by Mr. Walker, the draft permit approved by unanimous vote, Aye-6 No-0
Motion carried.

The Chairman noted that this permit will be contingent on APA approval, which has not been received yet. On a motion to approve the draft permit with the contingency, by Mr. Wrisley, seconded by Mrs. Alexander, the motion carried by unanimous vote, Aye-6 No-0
New Business
Tax Map #40.73-2-7.000 -CATS/CEVE Kiosk -Site Plan Review -Accessory structure sign kiosk behind the Essex Town Hall, 2313 Main Street, Essex, NY 12936
There was a discussion of the application by the Planning Board. The applicant, Emily Phillips, advised that the dimensions may change slightly from what is being applied for. The Chairman advised that the final dimensions must be made to Planning before the Public Hearing for same. On a motion by Mr. Muller to deem the application complete with final dimensions by time of the Public Hearing, seconded by Mr. Hislop, the motion carried by unanimous vote, Aye-6 No-0
SEQRA: The Chairman advised that the EAF will be considered in conformance with SEQRA at the Public Hearing.
On a motion by Chairman Van Hoven to set up the Public Hearing for the August 21, 2014 meeting, seconded by Mr. Wrisley, the motion carried by unanimous vote, Aye-6
No-0.
Tax Map #40.75-5-8.000 -312 LLC -George Pataki -Site Plan Review Amendment to Permit #2014-2 for exterior changes to 312 School Street, Essex, NY 12936. David Sayre appeared as the representative for the Pataki’s.
On a motion to approve the Amendment to Permit #2014-2, for exterior changes to former Hill house at 312 School Street, Essex, by Mr. Hislop, seconded by Mr. Wrisley, the motion carried by unanimous vote, Aye-6 No-0.
Tax Map #40.73-1-6.000 -Emily Gardner Phillips, Phillips Art Conservation Studio LLC, to occupy the old ReNew space at the ECHO building, 2728 NYS Rt. 22, Essex, NY12936.
The Chairman advised that this application should be a Special Use Permit and that will be reflected in the draft permit. Mr. Hislop recuses himself as he is President of the Board of Directors of ECHO. On a motion to deem the application complete and waive the Public Hearing by Chairman Van Hoven, seconded by Mrs. Alexander, the motion carried by unanimous vote, Aye-5 No-0 Abstain-1 (Hislop).
The EAF was considered in conformance with the SNY DEC SEQRA law and was deemed a negative declaration by the Planning Board by unanimous vote, Aye-6 No-0.
Tax Map #49.1-1-12.000 -George and Libby Pataki -Site Plan Review for construction of a new single family dwelling at 44 Farm Way, Essex, NY12936 (South Farm).
The Chairman advised the Planning Board that this is a significant project and a site visit would be appropriate. The application was discussed by the Board and the Pataki representative, Mark Hall. A permit application has been made to the APA. On a motion to deem the application complete by Mr. Muller, seconded by Mr. Hislop, the motion carried by unanimous vote, Aye-6 No-0.
The EAF was considered in conformance with the SNY DEC SEQRA law and was deemed a negative declaration on a motion by Mr. Muller, seconded by Mrs. Alexander and carried by unanimous vote, Aye-6 No-0.
A motion to hold a Public Hearing by Mr. Muller, seconded by Mr. Wrisley, the vote to hold the public hearing on August 21, 2014, carried by unanimous vote, Aye-6 No-0.
Report of the Chairman
The Chair advised that he had met with Ann Holland today to go over an amended SEQRA for the proposed Zoning Law. This is necessary as several further proposed changes in the law were made after the initial SEQRA was approved. These changes must also be reviewed in the SEQRA process. Ann will do this analysis.
Report of the Zoning Officer
Lauren Murphy discussed her report. Rental properties were discussed. The Chair asked about the vacant trailer on the Leaning Road and the CEO, Lauren Murphy, advised that the owner was sent an order to remedy.
Public Comment
Lauren Murphy asked Mr. Hislop about the demolition of an older Burnham camp in the Crater Club that may come to Planning in the future.
Adjournment
On a motion to adjourn the regular meeting by Mr. Muller, seconded by Chairman Van Hoven, the meeting is adjourned by unanimous vote, Aye-6 No-0, motion carried and the meeting is adjourned at 8:04 p.m.
